These Terms of Sale (“Terms”) govern purchases from ChartHouse International Learning Corporation (“ChartHouse,” “FISH! Philosophy,” “we,” “us”) made through our websites — including fishphilosophy.com, shop.fishphilosophy.com, and learn.fishphilosophy.com — and purchases made by invoice. By placing an order, you agree to these Terms, to our Refund & Shipping Policy, to our Privacy Policy, and — for any purchase that includes access to our content — to our Subscription License Agreement, each of which is incorporated into these Terms by reference.
If you are purchasing on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and the organization.

Product descriptions on the applicable offer page at the time of your purchase describe what is included in your order.
All prices are stated in US dollars. The price for your purchase is the price displayed at checkout (or on your invoice, for invoiced orders) at the time you place your order.
Payment is collected at the time of purchase and processed by third-party payment processors. We do not store your full payment card number on our servers. By submitting payment, you authorize the charge for the total shown at checkout.
We may change prices at any time; price changes do not affect orders already completed. If a product is listed at an obviously incorrect price or with an obviously incorrect description due to an error, we may cancel affected orders and refund any amount paid.
Your order is an offer to purchase. We accept your order when we provision your access or ship your items, whichever applies. We may refuse or cancel any order — including for suspected fraud, payment failure, pricing or description errors, or product unavailability. If we cancel an order after payment has been collected, we will refund the amount paid for the canceled order.
Except where these Terms expressly state that we will issue a refund (such as an order we cancel under Section 3), all sales are final and non-refundable — including recurring annual renewal charges — as described in our Refund & Shipping Policy. Because our subscription and trial products deliver immediate access to licensed digital content, no refunds, credits, or partial refunds are issued once access has been provisioned.
The trial is a one-time fee, collected at checkout, providing access to the included digital content for 30 days.
Under the book offer, the book is free and you pay only the shipping and handling charge displayed at checkout. The offer is subject to availability, is available to customers in the United States only, and orders ship to United States addresses only. Shipping, address accuracy, and delivery issues are governed by our Refund & Shipping Policy.
Shipping of physical items — including first-year subscription materials, programs on DVD or USB, book orders, and physical add-ons — is governed by our Refund & Shipping Policy, including its provisions on address accuracy, undeliverable packages, damaged items, and international orders.
Prices do not include taxes unless stated otherwise. Where we are required to collect sales or use tax, it will be added at checkout or shown on your invoice. You are responsible for any other taxes, duties, or governmental charges associated with your purchase.
All video programs, digital downloads, and other content we provide are licensed, not sold. Your use of the content is governed by our Subscription License Agreement — including its Media License terms for programs purchased on DVD or USB — which limits use to your organization’s internal training purposes and prohibits redistribution, public posting, and use of the content to deliver services to third parties. Your purchase does not transfer any ownership of our content or intellectual property.
Government and institutional buyers may purchase through our quote and invoice process: submit a quote request, provide a purchase order, and receive an invoice with payment terms. A government or educational email address is required for invoicing eligibility. Access is provisioned promptly following payment of your invoice or, for installment arrangements, payment of the first installment.
Invoice payment terms, including any installment schedule, affect payment timing only — they do not reduce the amount owed for the order. If any installment is not paid when due, the entire remaining balance for the order becomes immediately due and payable. Invoiced amounts include applicable sales and use taxes. Invoiced orders are subject to these Terms, our Refund & Shipping Policy, and our Subscription License Agreement to the same extent as orders placed online, and the license reference on your invoice incorporates the Subscription License Agreement.
You agree to provide accurate, complete information when ordering and to keep your account information current. You are responsible for safeguarding your account credentials and any team access PIN, and for use of your subscription by people within your organization. Notify us promptly at customerservice@fishphilosophy.com if you believe your access has been compromised.
By making a purchase or submitting your information to receive free resources or offers, you agree to receive email from us — including transactional messages about your order and account, and marketing messages about our resources, programs, and offers — as described in our Privacy Policy. You may unsubscribe from marketing email at any time; transactional messages related to your account and orders will continue while you have an active relationship with us.
Our products are training and educational materials. They are provided “as is” and “as available.” We do not warrant that the products will meet your requirements or produce any particular organizational, cultural, or business outcome — you bear responsibility for implementing the practices and skills our content teaches, and results vary by organization and implementation. Our content does not constitute legal, human resources, medical, or other professional advice. To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For physical materials, replacement as described in our Refund & Shipping Policy is your exclusive remedy for damaged or defective items.
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your purchase or use of our products; and (b) our total liability for all claims arising from or related to a purchase will not exceed the amount you paid us for that purchase in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
We may suspend or terminate your access if you materially breach these Terms or the Subscription License Agreement — including unauthorized sharing, redistribution, or public posting of licensed content, removal of watermarks, or unauthorized Commercial Use. No refund is issued for access terminated due to your breach. Sections of these Terms that by their nature should survive termination (including Sections 4, 10, 14, 15, and 18) survive.
FISH!, FISH! Philosophy, and associated logos and marks are trademarks of ChartHouse International Learning Corporation. All content, materials, and media we provide are protected by copyright and other intellectual property laws and remain our property or the property of our licensors.
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to their jurisdiction and venue. Each party waives any right to a jury trial to the extent permitted by law.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the documents incorporated by reference and your order confirmation, are the entire agreement between you and us regarding your purchase.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. The version in effect at the time of your purchase governs that purchase.
